These Terms of Service ("Terms") govern your access to and use of the software, website, and services (the "Service") provided by Teamtjie ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

These Terms are governed by the laws of the Republic of South Africa.

1. Eligibility

You must be at least 18 years old to use the Service.

By using the Service, you represent that you have the legal capacity to enter into a binding agreement.

2. Accounts

To access certain features of the Service, you must create an account.

You agree to:

  • Provide accurate and complete information
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorised access

You are responsible for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

You agree not to:

  • Use the Service for unlawful purposes
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorised access to systems or data
  • Reverse engineer, copy, or resell the Service
  • Use the Service in a way that infringes intellectual property or privacy rights

We may monitor usage to ensure compliance with these Terms.

4. User Content

You may submit or input content into the Service ("User Content").

You retain ownership of your User Content. By using the Service, you grant us a non-exclusive, royalty-free licence to process and store User Content solely for the purpose of providing the Service.

You are responsible for ensuring that your User Content:

  • Is lawful
  • Does not infringe third-party rights
  • Does not contain malicious code

We reserve the right to remove User Content that violates these Terms.

5. Subscriptions & Payments

Certain features of the Service require payment.

5.1 Subscription Plans
  • Subscription fees are billed in advance on a recurring basis
  • Pricing and billing intervals are displayed at checkout
  • Subscriptions renew automatically unless cancelled
5.2 Payment Processing

Payments are processed by our third-party payment provider, Paystack.

We do not store or process full payment card details.

6. Free Trials (If Offered)

If a free trial is offered:

  • The trial duration will be specified at signup
  • You may cancel at any time before the trial ends to avoid charges
  • If not cancelled, the subscription will convert to a paid plan automatically

7. Cancellations & Refunds

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period.

Refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.

Because the Service is a digital service:

  • Refunds for change of mind are not guaranteed once access has been provided
  • Refunds may be issued where required by the Consumer Protection Act (CPA) or where services are not delivered as agreed

8. Intellectual Property

All rights, title, and interest in the Service, including:

  • Software
  • Code
  • Design
  • Branding
  • Logos
  • Trademarks

remain the exclusive property of Teamtjie.

You may not copy, modify, distribute, or exploit any part of the Service without our prior written consent.

9. Feedback

If you provide feedback, suggestions, or ideas regarding the Service, you agree that:

  • We may use, implement, or incorporate them without compensation or attribution
  • You grant us a perpetual, irrevocable right to use such feedback

10. Availability & Changes

We strive to keep the Service available but do not guarantee uninterrupted access.

We may:

  • Modify or discontinue features
  • Perform maintenance
  • Update the Service from time to time

11. Limitation of Liability

To the maximum extent permitted by South African law:

  • The Service is provided "as is"
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability for any claim will not exceed the amount paid by you in the preceding 12 months

Nothing in these Terms limits rights that cannot be excluded under the CPA.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from:

  • Your misuse of the Service
  • Your User Content
  • Your breach of these Terms

13. Privacy & Data Protection

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

By using the Service, you consent to such processing.

14. Suspension & Termination

We may suspend or terminate your access if you:

  • Breach these Terms
  • Use the Service unlawfully
  • Pose a security or legal risk

Termination does not affect accrued rights or obligations.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

The courts of South Africa shall have exclusive jurisdiction over any disputes arising from these Terms.

16. Changes to These Terms

We may update these Terms from time to time.

Changes will be effective when posted. Continued use of the Service constitutes acceptance of the updated Terms.
